Reading tea leaves is risky business. But that is what many Supreme Court observers are doing in the wake of the oral arguments in Dobbs v. Jackson Women’s health Organization case. So, what is the case? Dobbs v. Jackson is a 15-week abortion ban from Mississippi. Dobbs is the most consequential case since Planned Parenthood v. Casey in which the SCOTUS affirmed Roe’s central findings.  At the center of the argument is the viability standard. Viability is now believed to be between at 21-24 weeks, but it is constantly changing and, hence, is not a workable framework.
